In consideration of the expenses of editing and publishing and the professional benefits relating to publication of my article or other written work described above (hereinafter referred to as the “Work”), I, on behalf of myself and any other contributing authors to the Work, hereby assign to the American Thoracic Society (“ATS”) all right, title, and interest in and to the Work and any graphics that may be contained in the Work, including, but not limited to, (1) the copyright and all rights subsumed thereunder, as well as all renewals and extensions thereof; (2) the right to grant permission to republish the Work in whole or in part with or without fee; (3) the right to reproduce the Work for sale or free distribution; and (4) the right to edit, print, publish, sell, reprint, and distribute the Work in any format and in any form or medium available worldwide and to make derivative works of the work. I acknowledge and agree that this assignment to the ATS also includes the right to translate, or to have translated, the Work and to publish, or to grant others to publish the Work in various countries, languages and in multiple media formats now known or later developed. Notwithstanding, I understand that ATS grants me a limited, non-exclusive, non- transferable license to use the Work in my professional capacity or employment. I acknowledge and agree that I am not permitted to sell or license the Work elsewhere for publication or other similar use, unless I obtain ATS’s prior written consent and provide attribution to ATS as the original place of publication.

In addition, I, on behalf of myself and any other contributing authors to the Work, affirm that I have seen and approved the final version of the Work and accept responsibility for its content; that the research (if applicable) is accurate; that all sources of financial support for the information and materials contained in the Work have been disclosed; and that this Work or any part of it is not subject to copyright or other rights except my own, and those of the contributing authors, to be assigned to the ATS and has not otherwise been submitted for publication, except under circumstances as communicated to the ATS in writing, at the time that this Work was first submitted.

I represent and warrant, on behalf of myself and any other contributing authors to the Work, that I have full right and power to make the assignment in this Assignment; that any contributing authors have granted all rights in the Work to me for assignment to ATS and that all contributing authors consent and agree to this Assignment; that the Work submitted by me for publication is original and free from any copyright restrictions; that any content or other material contributed by me does not violate any copyright, proprietary, or personal rights of others, and shall not contain any material from other copyrighted works without the written permission of the owner of such copyrighted material; that to my knowledge, the Work is factually accurate and contains no matter scandalous, libelous, unlawful, or otherwise actionable; that I have not previously in any manner disposed of any of the rights granted to ATS or previously granted any rights adverse or inconsistent with such grant of rights; and that there are no rights outstanding which would diminish, encumber, or impair the full enjoyment or exercise of the rights granted to ATS under this Assignment.

I acknowledge and agree that it shall be my responsibility to obtain written permission from the owners of any copyrighted material, illustrations, or other materials used in content created or provided by me to be included in the Work. Such permission shall entitle ATS to make full use of the copyrighted material to the extent ATS may otherwise dispose of its interests in the Work. Copies of any such permissions shall be provided to ATS when the final Work is submitted.

I agree to defend, indemnify and hold harmless ATS, its officers, directors, members, employees, agents, its licensees, and distributors, against any and all claims, losses, damages, liability, expenses (including attorney’s fees), and all other expenses relating or incidental to the inaccuracy or breach of any of my warranties or representations or failure to obtain any necessary permission from the owner(s) of any copyrighted material used in content created or provided by me to be included in the Work.
